It explains how we comply with the GDPR (General Data Protection Regulation), the DPA (Data Protection Act) [pre GDPR enforcement] and the PECR (Privacy and Electronic Communications Regulations).

The DPA & GDPR May 2018

This website complies with the DPA (Data Protection Act 1998) and already complies with the GDPR (General Data Protection Regulation) which comes into effect from May 2018. We will update this policy accordingly after the completion of the UK’s exit from the European Union.

WHAT DATA DO WE COLLECT ABOUT YOU, FOR WHAT PURPOSE AND ON WHAT GROUND WE PROCESS IT

We process this data to supply the goods and/or services you have purchased and to keep records of such transactions. Our lawful ground for this processing is the performance of a contract between you and us and/or taking steps at your request to enter into such a contract.

User Data that includes data about how you use our website and any online services together with any data that you post for publication on our website or through other online services. We process this data to operate our website and ensure relevant content is provided to you, to ensure the security of our website, to maintain back- ups of our website and/or databases and to enable publication and administration of our website, other online services and business. Our lawful ground for this processing is our legitimate interests which in this case are to enable us to properly administer our website and our business.

Technical Data that includes data about your use of our website and online services such as your IP address, your login data, details about your browser, length of visit to pages on our website, page views and navigation paths, details about the number of times you use our website, time zone settings and other technology on the devices you use to access our website. The source of this data is from our analytics tracking system. For tax purposes the law requires us to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for six years after they stop being customers.

We currently operate no mailing lists, newsletters or direct email marketing of any kind.

Clients’ Images – Their Storage and Retention

Clients’ images are only used on the website portfolio, social media sites and the blog with signed consent at the commissioning stage via contract of engagement. Images may be used to promote the business and be entered for awards/competitions.

Image Backup
Images are stored on the desk/laptop machines utilised for processing as well as backed up on password protected external hard drives. The workspace where these are normally held is locked as per insurance policy requirements. Backup methods will undoubtedly evolve over time and the policy will be altered accordingly. For convenience images and client emails may also be stored/accessed via our mobile devices. These are secured as per the individual product's protocol e.g. iPhone - private passcode or bio-key.

Image Retention

Copyright is held by the creator unless otherwise agreed. Statutory copyright rules apply. Once a commission has been delivered it is deemed complete with the future storage and maintenance of the images the responsibility of the client. Images may be held in our archives indefinitely for portfolio, promotional and reference purposes but this is not a guarantee.

Order Fulfilment

Every effort is made to ensure that images are kept private and are transferred via secure routes, usually uploaded direct digitally,  to our suppliers - processing labs, printers and publishers - to fulfil client orders. 

Social Media Policy & Usage

We adopt a Social Media Policy to ensure we conduct ourselves accordingly online. While we may have official profiles on social media platforms users are advised to verify authenticity of such profiles before engaging with, or sharing information with such profiles. We will never ask for user passwords or personal details on social media platforms. Users are advised to conduct themselves appropriately when engaging with us on social media.

There may be instances where our website features social sharing buttons, which help share web content directly from web pages to the respective social media platforms. You use social sharing buttons at your own discretion and accept that doing so may publish content to your social media profile feed or page. Online Print, Product or Image File Purchasing

Direct links to our proofing and ordering facility will be sent upon request. Clients can view their images within password protected galleries and can purchase prints and images via this part of the website. The gallery website is run by www.shootproof.com .
